Guard Cards That Were Renewed But The 4-Hour CE Class Not Completed Are Not In Compliance With State Law And The Rules Of The Board.
WHAT THE LAW SAYS ABOUT RENEWING YOUR GUARD CARD
(HRS 463-10.5 / Act 208)
(g) Prior to the June 30, 2016 renewal of the guard registration and every registration renewal hereafter, the applicant shall pay all required fees, and have had at least four hours of continuing education as specified in the rules of the board. The board may conduct a random audit, pursuant to rules adopted pursuant to chapter 91, of registrants applying for renewal of a registration to determine whether the continuing education requirements of this subsection have been met.
The failure, neglect, or refusal of any registered guard to pay the renewal fee or meet the continuing education requirements shall constitute a forfeiture of the guard's registration.
A forfeited registration may be restored upon written application within one year from the date of forfeiture, payment of the required renewal fee plus penalty fees, and meeting the continuing education requirements in effect at the time of restoration.
Renewal - Information From The DCCA
On-time renewals for licensing period of July 1, 2016 to June 30, 2018 began on Monday, May 9, 2016 and ended midnight (HST) Thursday, June 30, 2016.
Renewal postcard reminders for Private Detective (PDA) or Guard (GDA) Agency, Private Detective (PD) or Guard (GD) and Guard Employee (GDE) license types were mailed out May 6, 2016. The on-line renewal period opened May 9, 2016 and closed at midnight June 30, 2016. While the DCCA's computer system allowed a person to renew online without submitting proof of having completed the 4-hour Security Guard Continuing Education class (SGCE or CE), that class is mandatory and must be completed as part of the renewal process; those who renewed and did not complete the CE course are in violation of HRS §463-10.5; they did not fully complete the renewal process and the license is considered expired.
RANDOM AUDIT of Guard Employees: After the renewal period, the Board shall conduct a random audit, and for those selected, a notice will be sent from the Board and they will have 60 days to submit proof of having complied with the CE requirement. Failure to do so will result in disciplinary action being taken against their guard employee registration. Registrants shall maintain their own continuing education records.
Failure to timely renew by the renewal date will result in the forfeiture of the license. After the renewal date, the forfeited license may be restored within 1 year and subject to meeting restoration requirements. Failure to restore a forfeited license within 1 year after the renewal date will result in the termination of the license and the person must apply as a new applicant and meet current licensing requirements.
Late renewals/restorations for GDE license types not renewed by June 30, 2016 must be submitted by hardcopy and must include proof of completion of the required (4) hour continuing education (CE) course and are subject to a late renewal fee. Contact the DCCA/PVL to request a restoration application at 808-586-3000. The restoration form will include a bar code for processing along with the GDE’s specific information, thus requiring the form be requested by phone or post (or in person at 335 Merchant St. room 301) The form will not be available online.
